HEALLIST INC. PRIVACY POLICY
This Privacy Policy applies to Heallist Inc.’s ("Heallist"; "we"; "our";or "us") website at Heallist.com (our "Site"), our mobile apps for mobile devices (our "Apps"), and to our other products and services (collectively, our "Service"). This Privacy Policy explains how we collect, use and disclose personal information of the users of our Service, including practitioners who use the Service to list their services and/or to offer treatment ("Practitioners") and customers who are interested in obtaining such services and/or treatments ("Customers"). By accessing or using our Site, Apps, or our Service, you agree that you have read and understood this PrivacyPolicy, so please review it carefully.
1. HOW WE COLLECT YOUR INFORMATION
When we use the term "personal information" we mean any information that can be used to identify you, directly or indirectly, as an individual person. We collect personal information in connection with your visits to and use of the Service. This collection includes information that you provide in connection with the Service, information from third parties, and information that is collected automatically, such as through the use of cookies and other technologies.
A. Information You Provide to Us Directly
• If you create an account or a profile on our Service, we may collect your full name, phone number, email address, home or business address, state of residence, date of birth, gender, account credentials such as username and password, payment card information, licensure information, photos, videos, and we may display this information on your profile page and use it to provide you with our Service.
• With your permission, Heallist may also access the contact lists available on your mobile device, your email accounts, or in other information systems you connect with the Service, in order to locate clients on the Service and to invite them to use our Service, and we may also integrate our Service with your calendar system (such as Google Calendar) in order to sync your calendar entries with your Heallist schedule.
• If you contact us, we may collect your name, email address, mailing address, phone number, or any other personal information you provide to us, and use it to communicate with you, to enhance our Service, and to manage and grow our organization.
B. Information We Collect Automatically Through Your Use of the Service
• Our web servers keep log files that record data every time a device accesses those servers. As such, when you access the Site, we will automatically collect information such as your browser type and version, device and connection information, the Internet Protocol (IP) address used to connect your device to the Internet, and standard web log information. We may collect general geographic location based on your IP address or more precise geolocation with your permission when accessing our Service through a mobile device.
• As our Service includes, among other features, a video calling/conferencing feature, either provided by us or through a third party, which transmits and which may capture screen activity, Heallist may inadvertently collect information while you use this feature. This information may include physical addresses, email address, phone number, information related to contacts, photos, videos, web browsing history and other information visible on your screen while using this feature, which could also include personal data about you and/or others including without limitation data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic or biometric data, health data, or data concerning a person's sex life or sexual orientation. Heallist encourages all users to close out any information displayed on their screens before using the video calling/conferencing feature. To the extent personal data is captured during a session, it will be stored, secured and accessible only in the manner described in this Privacy Policy.
• We, and our third-party partners, automatically collect certain types of usage information when you visit our Service, read our emails, or otherwise engage with us. We typically collect this information through a variety of tracking technologies, including cookies, web beacons, embedded scripts, location-identifying technologies, file information, and similar technology (collectively, "tracking technologies"). For example, we collect information about your device and its software, such as your IP address, browser type, Internet service provider, platform type, device type, operating system, date and time stamp, a unique ID (that allows us to uniquely identify your browser, mobile device, or your account), and other such information. We also collect information about the way you use our Service, for example, the site from which you came and the site to which you are going when you leave our website, the pages you visit, the links you click, how frequently you access the Service, whether you open emails or click the links contained in emails, and other actions you take on the Service. Most internet browsers allow you to remove or manage cookie functions and adjust your privacy and security preferences. Please note, however, that disabling our cookies may mean that you will not be able to take full advantage of the Service.
• When you access our Service from a mobile device, we may collect unique identification numbers associated with your device or our Apps (including, for example, a UDID), mobile carrier, device type, model and manufacturer, mobile device operating system brand and model, phone number, and, depending on your mobile device settings, your geographical location data (with your permission), including GPS coordinates (e.g., latitude and/or longitude) or similar information regarding the location of your mobile device, or we may be able to approximate a device’s location by analyzing other information, like an IP address.
• We may obtain information from other sources, including through third-party information providers or through transactions such as mergers and acquisitions. We may combine this information with other information we collect from or about you. In these cases, our Privacy Policy governs the handling of the combined personal information. We use this information to operate, maintain, and provide to you the features and functionality of the Service, as well as to communicate directly with you, such as to send you email messages about products and services that may be of interest to you. We may also collect information about you that is publicly available.
• We may receive personal information about you from third parties and combine that with information we collect through our Service. For example, when you interact with us through a social media site or third-party service, such as when you like, follow, or share Heallist content on Facebook, Twitter, Instagram, or other sites, we may receive information from the social network, including your profile information, picture, user ID associated with your social media account, and any other information you permit the social network to share with third parties. The data we receive from these third-party sites is dependent upon that third party’s policies and your privacy settings on that third-party site. You should always review and, if necessary, adjust your privacy settings on third-party websites and services before linking or connecting them to our Service.
• Although we do our best to honor the privacy preferences of our visitors, we are not able to respond to ‘Do Not Track’ signals from your browser at this time.
2. HOW WE USE YOUR INFORMATION
We use the information we collect for purposes described in this Privacy Policy or as otherwise disclosed to you on our Service or in connection with our Service. For example, we use your information to set up your account, verify your phone number, and deliver the Service to you; send you transactional information, including confirmations, invoices, technical notices, product and services information, updates, security alerts, support and administrative messages, and information about your account with us; communicate with you such as to respond to your comments and questions, provide customer service or feedback, or for any other purposes in connection with the Service; provide you with news about products and services offered by us; operate, maintain, test, enhance, update, monitor, diagnose, fix and improve our Service; prevent, investigate or provide notice of fraud or unlawful or criminal activity, unauthorized access to or use of personal information, our data system services, and to meet governmental and institutional policy obligations; enforce and carry out contracts and agreements with our customers; investigate and resolve disputes and security issues and to enforce our Terms of Service; comply with legal obligations; and for any other lawful business purpose.
3. HOW WE SHARE YOUR INFORMATION
We may share personal information with:
• other users of the Service, as needed to provide the Service to you. For example, if you are a Customer, some of your information may be shared with your chosen Practitioner in order to facilitate scheduling and communication.
• other companies and brands owned or controlled by Heallist and other companies owned by or under common ownership with Heallist, which also includes our subsidiaries (i.e., any organization we own or control) or our ultimate holding company (i.e., any organization that owns or controls us) and any subsidiaries it owns. These companies will use your personal information in the same way as we can under this Privacy Policy.
• third-party service providers that perform services on our behalf, as needed to carry out their services for us (for example, technology support, accounting services, web hosting, analytic services, video calling/conferencing, payment processors, etc.)
• other parties in connection with a company transaction, such as a merger, sale of company assets or shares, reorganization, financing, change of control, or in the event of a bankruptcy or related or similar proceedings.
• third parties as required by law or subpoena or if we reasonably believe that such action is necessary to (a) comply with the law and the reasonable requests of law enforcement or governmental regulatory authorities; (b) to enforce our Terms of Service or to protect the security or integrity of our Service; and/or (c) to exercise or protect the rights, property, or personal safety of Heallist, our visitors, or others.

4. THIRD-PARTY TRACKING
• We use Google Analytics to recognize you and link the devices you use when you visit our site or Service on your browser, log in to your account on our Service, or otherwise engage with us. We share a unique identifier, like a user ID or hashed e-mail address, with Google to facilitate the service. Google Analytics allows us to better understand how our users interact with our Service and to tailor content to you. 5. CONTROL OVER YOUR INFORMATION
• If you have questions about reviewing, changing, or deleting your information, you can contact us directly at [email protected]. We may not be able to modify or delete your information in all circumstances.
• You may control our App’s access to your device information through your ‘Settings’ app on your device. For instance, you can withdraw permission for the App to access your location, camera, camera roll, and/or address book.
• You can stop receiving promotional email communications from us by clicking on the ‘unsubscribe link‘ provided in such communications. We make every effort to promptly process all unsubscribe requests. You may not opt out of service-related communications (e.g., account verification, transactional communications, changes/updates to features of the Service, technical and security notices).
6. CHILDREN’S PRIVACY
• Heallist does not knowingly collect or solicit any information from anyone under the age of 13 on this Service. In the event that we learn that we have inadvertently collected personal information from a child under age 13, we will promptly delete that information. 7. LINKS TO OTHER WEBSITES AND SERVICES
• The Service may contain links to and from third-party websites of our business partners and social media sites and our users may post links to third-party websites. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for their policies. We strongly recommend that you read their privacy policies and terms and conditions of use to understand how they collect, use, and share information. We are not responsible for the privacy practices or the content on third-party websites.
8. GOOGLE CALENDAR™ INTEGRATION
Our platform offers the option for users to connect their accounts to Google Calendar in order to create and manage appointments and events through our app and for an overall enhanced user experience. By choosing to connect to Google Calendar, you agree to the following terms:
• Google Terms of Use. Before connecting to Google Calendar, you must accept and comply with Google's Terms of Use. Ensure that you have an existing Google Account or create one as part of the connection process.
• Information Accessed. Upon connection, our platform may access and retrieve information from your Google Calendar, including but not limited to events, reminders, calendar availability, and other calendar-related data. Our app may add to your calendar appointments scheduled through our app.
• User Control. We understand the importance of privacy and provide users with the ability to manage their connection to Google Calendar. You can disconnect your account at any time through your account settings on our platform.
• Data Security. We prioritize the security of your data. Any information retrieved from Google Calendar is handled securely and in accordance with our Privacy Policy.
• Third-Party Authorization. By connecting to Google Calendar, you authorize our platform to interact with your Google Account on your behalf. This authorization is revocable, and you can disconnect your account at any time.
• Changes to Google Calendar Integration. We reserve the right to modify or discontinue the Google Calendar integration feature at our discretion. In such cases, users will be notified in advance.
9. ZOOM® INTEGRATION
The Heallist app offers seamless integration with Zoom to enhance user experience and facilitate efficient communications. By connecting your Zoom account with our app, you acknowledge and agree to the following:
• User Connection; Account Management. Before initiating the connection, you should possess a Zoom account. By connecting your account to Zoom through our platform, you agree to abide by the Zoom Terms of Use. Please carefully review and understand these terms, as they govern your usage of Zoom services. Our platform assumes no responsibility for the content, policies, or practices outlined in the Zoom Terms of Use.
• Upon Connection. Users retain control over their Zoom Account. Our app may create Zoom meetings for appointments scheduled through our platform and may also access and retrieve information from your Zoom Account. This functionality is designed to streamline the scheduling process and enhance user experience. Users will be able to access their Zoom meetings directly from their Zoom app as well as from our app and can manage their settings directly within the Zoom platform. Any changes made within the Zoom platform will be reflected in our App, and vice versa. This dual access ensures flexibility and convenience for our users, allowing them to manage and join their appointments seamlessly.
• Account Disconnect. You retain the right to disconnect your Zoom account from our app at any time. This disconnection can be managed through the account settings on our platform. By disconnecting Zoom on our app, you are discontinuing the integration between our platform and Zoom, and thereby revoking our platform's access to your Zoom data.
• Data Handling. Upon disconnecting, any data previously obtained during the connection of your Zoom to our app will be handled in accordance with our privacy policy, in compliance with relevant data protection laws.

11. CHANGES TO OUR PRIVACY POLICY
• We may modify or update this Privacy Policy from time to time, so you should review this page periodically. When we change the Privacy Policy in a material manner, we will let you know and update the date on this page. If you object to any changes, you may stop using our Service. Continuing to use our Service after we publish changes to this Privacy Policy means that you understand and are acknowledging the changes.
